Setting the record straight – Printwear Today clears its name

Printwear Today need no longer live under the cloud of suspicion – following the recent court case between Datateam Publishing Ltd (Claimant) and Nick Carpenter (defendant).

Printwear Today need no longer live under the cloud of suspicion – following the recent court case between Datateam Publishing Ltd (Claimant) and Nick Carpenter (defendant).
It had been alleged by Datateam Publishing Limited (publishers of P&P) in their Particulars of Claim that: (1.) in breach of his contract of employment Nicholas Carpenter retained a copy of Datateam Publishing Limited’s list of potential advertisers, and (2.) that Nicholas Carpenter used this list to his advantage and to the detriment of Datateam Publishing Limited.
In the witness statement of Datateam Publishing Limited’s Managing Director, Parvez Kayani, it was alleged that Nicholas Carpenter had admitted retaining a copy of Datateam Publishing Limited’s advertisers and subscribers list.
The case was held before the Central London Country Court on March 3. Upon hearing counsel for Datateam Publishing Limited and counsel for Nicholas Carpenter the Central London County Court made the following order:
1. The Claimant is refused permission to rely on the evidence of in a witness statement of Mr Kayani dated 28th February 2008.
2. The Claimant’s application to adjourn the trial is refused.
3. The Claim is struck out.
4. The Claimant is to pay the costs of the proceedings to the Defendant on an indemnity basis, such costs to be assessed if not agreed.
5. By 4pm on the 20th March 2008 the Claimant is to make an interim payment of costs of £10,000.00 to the Defendant.
Commenting Nick Carpenter said, “Since the launch of Printwear Today, there have been false rumours circulating the industry – we are therefore delighted to be able to clear our name – and hope this now puts the matter to rest. We have completely vindicated ourselves from any wrongdoing and the rumours that have been circulating in the industry. It is only fair that Datateam Publishing Ltd have been ordered to pay our legal costs on an indemnity basis from day one.”
Delighted with the result, Nick added, “It has been an extremely stressful time, and it had been difficult for us to defend these comments, without jeopardising the court case. Naturally we are extremely delighted with the outcome, which has highlighted that the circulation list of Printwear Today is totally unique and did not originate from a competitive publication.”
